Prime Charter Bus LLC Transportation Service Terms and Agreement

Welcome to Prime Charter Bus LLC (“Prime Charter Bus”). This Transportation Service Terms and Agreement (the “Agreement”) governs your use of our charter services. By making a reservation, utilizing our services, or otherwise accepting this Agreement, you confirm that you have read, understood, and agree to be bound by these terms.

1. Reservations and Deposits

By accepting this Agreement, you affirm that (a) you are authorized to enter into these terms for yourself and, if applicable, for your organization; (b) you and your organization are legally capable of entering into this Agreement; and (c) you agree to be bound by the terms outlined herein.

2. Reservation and Payment

  • Deposit: A 30% non-refundable deposit is required. The deposit must be received at the time of booking

  • Full Payment: Full payment must be sent electronically 14 days before the charter date. Accepted methods include Credit Card, Wire Transfer, ACH Transfer, Zelle, or Venmo. Processing fees (3% for card payments) are the client's responsibility.

  • Security Deposit: A refundable security deposit of $250 is due 14 days before the trip. This deposit will be returned post-trip if there are no overage fees or additional cleaning required. Processing of the security deposit refund may take up to 15 days.

  • Card Authorization: By providing your payment information, you authorize Prime Charter Bus to charge the card on file for any outstanding balances or additional charges incurred, including overtime and damage costs, without additional consent.

3. Cancellation and Refunds

  • Cancellation Policy: Cancellations must be made in writing at least thirty (30) days before the service date to avoid being charged 100% of the contracted amount. All deposits are non-refundable.

  • Performance Failures: In case of a Performance Failure by Prime Charter Bus, you may be eligible for a partial refund, but this does not affect charges for other services or buses.

  • No-Show Policy: If you are not present at the scheduled pick-up location and cannot be contacted within 60 minutes, the reservation is considered a no-show, and you will be liable for 100% of the Estimated Cost.

4. Overtime and Additional Charges

  • Overtime Fees: Any overtime incurred will be billed in hourly increments at a rate of $250 per hour. Time begins when the Service Bus arrives at the pick-up location.

  • Additional Expenses: You will be responsible for additional costs including road tolls, parking, park or airport entrance fees, driver gratuity, driver lodging, and any extra stops. Prime Charter Bus will provide minimum lodging standards for drivers if required.

5. Subcontracting

  • Subcontracting: Prime Charter Bus LLC may subcontract to affiliate partners. Pricing remains unchanged, and all bookings must go through Prime Charter Bus LLC.

6. Liability and Service Limitations

  • Limitations: We are not liable for damages due to weather, mechanical issues, traffic delays, or unforeseen events. If a bus breakdown occurs but a replacement bus is provided, no partial or full refund will be issued.

  • Force Majeure: Prime Charter Bus is not liable for failure to perform due to causes beyond its control, including natural disasters, strikes, or other unforeseeable events.

7. Lost Items

  • Responsibility: We are not responsible for items left in the vehicle. Please check the vehicle before departure.

8. Cleaning and Damage Fees

  • Cleaning Fees: The client is responsible for ensuring that the vehicle is returned in a reasonably clean condition. If excessive trash or mess is left behind, a cleaning fee will be assessed. This fee is in addition to any standard cleaning charges and will be determined based on the extent of the cleaning required.

  • Damage Fees: The client will be held liable for any damage caused to the vehicle during the charter. This includes, but is not limited to, damage to upholstery, flooring, or fixtures. Repair or replacement costs will be charged to the client. Any such fees will be deducted from the security deposit or invoiced separately if the deposit does not cover the full amount.

  • Assessment and Notification: Prime Charter Bus LLC will assess any cleaning or damage fees after the trip and provide the client with a detailed invoice. If necessary, we may deduct these fees from the security deposit, with any remaining balance returned to the client within 15 days.

9. Non-Dispute of Credit Card Payments

  • Payment Confirmation: By signing this agreement, the client acknowledges and agrees that all payments made via credit card are final and non-refundable, except as expressly provided in the terms of this agreement.

  • Chargeback Policy: The client agrees not to dispute or initiate a chargeback with their credit card company for any payments made to Prime Charter Bus LLC. In the event that a chargeback is initiated, the client will be responsible for any associated fees or costs incurred by Prime Charter Bus LLC as a result.

  • Resolution of Disputes: Any disputes related to charges must be resolved directly with Prime Charter Bus LLC. The client agrees to provide a reasonable opportunity for Prime Charter Bus LLC to resolve any issues before initiating a chargeback or payment dispute with their credit card issuer.

10. Passenger Conduct

  • Behavior Expectations: Passengers must adhere to the rules of conduct. Smoking, alcohol consumption, and disruptive behavior are prohibited. Non-compliance may result in additional charges or termination of service.

11. Insurance and Disclaimers

  • Insurance Coverage: Prime Charter Bus provides commercial insurance but does not cover personal property or injuries. You are encouraged to obtain your own insurance.

  • Disclaimers: Prime Charter Bus makes no warranties beyond those explicitly stated in this Agreement.

12. Governing Law and Dispute Resolution

  • Applicable Law: This Agreement is governed by the laws of the state where Prime Charter Bus is incorporated.

  • Arbitration: Disputes will be resolved through binding arbitration according to the rules of the American Arbitration Association in the state where Prime Charter Bus is incorporated.

13. General Provisions

  • Entire Agreement: This Agreement represents the complete understanding between you and Prime Charter Bus and supersedes all previous agreements.

  • Waiver: No waiver of any term or condition will be deemed a further waiver of that term or any other term.

  • Severability: If any provision is found to be invalid, the remaining provisions will continue in full force and effect.

Acknowledgment

  • Client Acknowledgment: By using our Charter Services, you acknowledge that you have read, understood, and agreed to these terms.
